Billing, Late Payment, and Account Deletion Policy
This document serves as an official addendum to the Terms of Service for the Sendfy software-as-a-service platform (accessible via sendfy.app). By subscribing to and utilizing our automation services (including WhatsApp and SMS API routing), you explicitly agree to the financial terms and structural retention rules detailed below.

  1. Subscription Billing and Grace Period
Sendfy operates on a prepaid subscription basis. Access to the software, automation tools, message delivery pipelines, and API integrations is granted contingent upon active, fully paid subscription plans. Billings are processed on a recurring basis as determined during your initial setup (monthly, quarterly, or annually).
  2. Non-Payment and Automatic Account Deletion (3-Day Policy)
To optimize infrastructure performance, protect data security, and maintain the integrity of our high-volume routing systems, Sendfy enforces a strict policy regarding accounts with past-due balances.

CRITICAL RETENTION NOTICE:
If a subscription payment fails, or if an account enters an unpaid status for any reason, the user will have a maximum grace period of 3 (three) consecutive calendar days to regularize the outstanding balance. On the 4th day of continuous unpaid status, the account will be automatically terminated, resulting in the permanent, immediate, and irreversible deletion of all stored data, integration configurations, webhooks, and communication histories.

  1. Data Scope Subject to Irreversible Erasure
Upon reaching the 3-day non-payment threshold, the automated maintenance protocol will completely wipe the subscriber’s environment. The following data categories will be permanently deleted and cannot be recovered by our engineering team:

Message Logs and Histories: Records of all incoming and outgoing automated WhatsApp messages, SMS logs, delivery reports, and payload details.

API Configurations: Secret keys, active WhatsApp session tokens, instance bindings, webhook URLs, and endpoint route setups.

Contact Lists and Databases: Imported subscriber lists, custom attributes, segmented contact groups, and static recipient data.

Automation Workflows: Chatbot configurations, visual canvas builders, response rules, auto-replies, and message templates.

Billing Status & Consequences Reference:
Day 0 (Due Date): Payment failure or cancellation. System triggers automated renewal notices. Required Action: Payment needs to be successfully updated in the billing portal.

Days 1 to 3: Account enters grace period. Automation and message routing are suspended. Required Action: Immediate payment is required to restore automated message delivery.

Day 4 (Post 3 Days): Permanent Account Deletion. Consequence: All historical logs, settings, and automation instances are completely wiped. Recovery is impossible.

  1. Notices and Communications
Sendfy will attempt to notify the registered account owner of billing issues using automated emails and/or WhatsApp alerts sent to the contact information on file. However, it remains the sole responsibility of the user to ensure that payment details are up-to-date and that payments are processed successfully. Failure to receive an automated notification does not exempt the account from the 3-day deletion schedule.
  2. Limitation of Liability
By using Sendfy, you acknowledge and agree that Sendfy, its parent company, founders, and affiliates shall not be held liable for any loss of business, disruption, loss of data, loss of contacts, or financial damages resulting from the automated deletion of your account due to non-payment beyond the 3-day grace period.
